Concession Contract

The formal administrative contract between a government and a private entity granting the right to operate casino gaming. In Macau, concession contracts are awarded through a mandatory public tender process and specify the concessionaire’s rights and obligations, including the types of games permitted, the concession term, investment commitments, employment obligations, tax obligations, non-gaming investment requirements, and grounds for termination. Concession contracts represent a heavy regulatory burden and are subject to ongoing government supervision. Macau’s 2023 concession contracts include significant non-gaming investment requirements and stronger government oversight provisions.
